Kraftwerk Just Accidentally Legalized Sampling In Germany

As previously reported, Kraftwerk’s Ralf Hütter took German producer Moses Pelham to court for a sample he used in a 1997 production. The two seconds Pelham used from Kraftwerk’s “Metall auf Metall” raised the important question of what a sample is and how long it can be before being considered copyright infringement. Now the Federal Constitutional Court decided against Hütter and basically legalized sampling in Germany. In the long run, that means Kraftwerk themselves have helped legalize German hip hop and other sample based genres.
